As introduced: - Creates strict liability for developers of covered models for any injuries to a non-user that was factually and proximally caused by a covered model that would be a tort or crime if undertaken by a human and was not intended or reasonably anticipated by the user. - Creates a rebuttable presumption that the AI system satisfies the relevant mental state if the finder of fact determines that a human would have acted with the relevant mental state. - Creates an affirmative defense if the developer establishes the covered model satisfies the standard of care applicable to humans that perform the same function. or if the injuries sustained were a result of capabilities failure.
