As introduced: - Prohibits surveillance pricing, defined as "offering or setting a customized price for a good or service for a specific consumer or group of consumers based, whole in part, on personally identifiable information collected through electronic surveillance technology. - Establishes "electronic surveillance technology" includes, but is not limited to, the use of sensors, cameras, device tracking, biometric monitoring, and other forms of observation or data collection capable of gathering personally identifiable information, such as a consumer's behavior and characteristics, and a consumer's location or other personal attributes in physical and digital environments. - Exempts legitimate cost differences in the product or service, publicly disclosed discounts, group-based discounts, loyalty programs, and insurance pricing. - Requires a discounted price or reward offered through a loyalty program, mailing list, or other permitted exemption that collects personally identifiable information to clearly and conspicuously disclose any eligibility criteria and available discounts or rewards and their necessary conditions before collecting any personally identifiable information.
