As introduced: - Prohibits entities from setting the price of a good or service using personalized algorithmic pricing based on a consumer's personal data. - Requires entities that use automated pricing systems based on non-personal factors to disclose the use of such a system and the categories of inputs that influence the price. - Establishes a private right of action for individuals harmed by a violation, allowing for statutory damages, actual damages, and attorneys' fees. - Increases the civil penalty for a first-time violation to $10,000 and establishes a $25,000 penalty for each subsequent violation. - Exempts loyalty programs, provided that: - Participation is voluntary; - All members of the program receive uniform pricing benefits and discounts; - Pricing benefits are not based on personal data collected outside the loyalty program or on behavioral profiles unrelated to program transactions; and - The program provides clear and conspicuous disclosure of all data 2 practices
