As introduced: - Requires a chatbot provider to clearly and conspicuously notify a user that they are interacting with a chatbot and not a natural person. - Prohibits a chatbot provider from selling a user's chat logs and from processing personal data or chat logs for purposes such as advertising or training without first obtaining the user's affirmative consent. - Prohibits a government entity from compelling access to a user's input data or chat logs without a wiretap warrant. - Designates a chatbot as a product for the purposes of a product liability action, establishing a duty of care for providers. - Creates a private right of action for users to bring a civil action against a chatbot provider for violations, allowing for civil penalties, damages, and other relief.
