As substituted on 2/3/2026: - Requires deployers of high-risk artificial intelligence systems to use reasonable care to prevent algorithmic discrimination, maintain a risk management program, and conduct impact assessments. - Requires each high-risk AI system developer and deployer to implement a risk management policy. Exempts small businesses. - Requires deployers to notify a consumer when a high-risk artificial intelligence system is used to make a consequential decision. - Requires a deployer of a high-risk AI system to complete an impact assessment. Exempts small businesses. - Requires a government agency to disclose to a consumer when the consumer is interacting with an artificial intelligence system. - Establishes an artificial intelligence workplace advisory group to develop guiding principles for the use of AI in the workplace. - Authorizes the attorney general to enforce the act's provisions under the state's Consumer Protection Act. - The 2/3/2026 substitution narrows the definition of "consumer", clarifies "deployer", and "intentional and substantial modification", exempts government from "person", clarifies "substantial factor", and adds definitions for "meaningful human consideration." Requires developers and deployers to implement risk management policy. Clarifies developers are not required to provide documentation to affiliated deployers. Exempts small businesses from risk management requirements. Exempts insurers. Clarifies there is no private right of action.
