As amended on 3/6/2026: - Requires a conversational AI services to disclose to users that they are interacting with an AI and not a human if a reasonable person would believe the interaction was with a human. - Requires conversational AI services to disclose to a minor they are interacting with an AI and not a human at the beginning of a conversation and once every three hours. - Requires operators to implement suicide-prevention protocols, limit personal data collection and use, and prohibit targeted advertising or behavioral manipulation using user data. - Establishes specific protections for users known to be minors, including prohibitions on manipulative design features to increase engagement and the generation of sexually explicit or emotionally dependent content. - Requires annual safety reporting to the Department of Commerce and Consumer Affairs and authorizes the Attorney General to enforce the act's provisions. - The 2/10/2026 amendment modifies the disclosure for minors from every hour to once every three hours. Deletes the requirement for preventing suicidal ideation or self-harm content. Deletes requirement for disclosure that content may not be suitable for minors and notice that operator has a duty of care and liability. Adds prohibition on a chatbot from making a representation the AI is a human where the user is seeking crisis intervention services. Deletes requirements that operator take steps to prevent chatbot from leading a minor user to think it is a human. - The 3/6/2026 amendment apply restrictions on personal data and targeted advertising to all users, not just minors. Specifies that violations constitute an unfair or deceptive trade practice under Hawaii law.
