As passed the House: - Prohibits retailers from using surveillance pricing in the sale of food that qualifies for the federal SNAP or WIC programs. - Establishes civil fines of up to $5,000 per item per day and administrative fines for violations. - NOTE: 3/6 amended version removes the exemption for loyalty programs. - NOTE: 2/18 amended version: - Expands the surveillance pricing prohibition to cover the sale of food per the definition provided, rather than food sold to recipients of certain federal programs; - Strikes language relating to penalties that conflicted with existing penalties under laws relating to unfair or deceptive acts or practices; - Exempts restaurants and other establishments that prepare and sell food directly to consumers for immediate consumption, including locations located within retail establishments. - NOTE: 2/11 amended version adds and defines "personally identifiable information" and extends the effective date to July 1, 3000 to encourage further discussion.
