As amended 2/12/2026: - Includes operating a motor vehicle while holding or physically supporting a wireless communications device, except when activating or deactivating the device, in the definition of careless driving, and imposes an additional $60 fine. - Allows a person who commits a first offense to participate in a wireless communications device driving safety program in lieu of the assessment of the fine. - Exempts various actions from enforcement, such as when using a device is a hands-free manner, reporting an emergency, or operating an autonomous vehicle. - Provides that a person's phone billing records may only be admissible as evidence if a crash results in serious bodily injury or death of another person. - Adds exceeding the speed limit to the list of crimes that, when committed simultaneously or in succession, are considered an offense of aggressive careless driving. - NOTE: 2/10 amendment adds language relating to AVs and phone records, and removes the following provisions: - Establishes increased penalties for violations that occur in a school or work zone, including a $150 fine and 3 driver license points for a first offense.
