As enacted: - Prohibits corporations and other entities from offering or advertising mental health services to the public, including services delivered through artificial intelligence, unless the services are provided by a licensed mental health professional or as part of an approved institutional review board or privacy board research study. - Clarifies that licensed mental health professionals may use HIPAA-compliant AI tools within their practice, provided they review and approve any mental health services delivered, and permits the use of FDA-authorized digital therapeutics or software-based medical devices when prescribed or recommended by a mental health professional. - Directs the Artificial Intelligence Advisory Council to report on the regulation of the use of artificial intelligence by mental health professionals, including recommendations for legislative action.
