As amended on 4/23/2026: - Prohibits the developer, modifier, or user of a healthcare AI system from using a healthcare professional's failure to override the system's output as a defense against liability. - Requires a health facility or clinic using a clinical automated decision system or generative artificial intelligence system for patient care to disclose detailed information about the tool to the using health care professional, including notice that the professional is permitted to override the tool's output. - Prohibits an employer from using or deploying technology to replace or limit a health care worker's professional judgment in patient care. - Prohibits an employer from retaliating against a health care worker for their decision to either override or comply with the output of an employer-approved technology. - The 4/9/2026 amendment specifies the disclosure.
