As enacted: - Replaces an incorrect certification examination requirement for welders on pressurized oil and gas process lines with specified, industry-recognized certifications. - Replaces commission enforcement actions references to "oil and gas operations" with "energy and carbon management operations" instead for terminological consistency. - NOTE: 3/13 amended version: - Prohibits individualized price-setting. - Allows differential prices based on customer selections, delivery distance, delivery time, temporal differences, publicly discounted prices offered on equal terms to consumers who meet the criteria, or members of a broad group, loyalty programs, discounts or rebates, or need-based discounts. - Prohibits individualized wage-setting unless disclosed before hiring a worker what data is considered and how the algorithm considers the data. - Requires price or wage setting algorithms to publish reasonable procedures to ensure accuracy, for workers to request and receive information on data considered, and to allow workers to correct or challenge data - NOTE: 3/16 version no longer relates to algorithmic pricing and replaces pricing language with technical changes for certification requirements and replaces oil and gas terminology with "energy and carbon management" as originally introduced.
