As introduced: - Prohibits the use of dynamic pricing for consumer items offered for sale at retail. - Defines "dynamic pricing" as a pricing system that adjusts the price of a consumer item at any time, including outside of a business' normal hours of operation, ans is based on external conditions, including but not limited to, the time of day, weather, and customer attributes such as location, purchase history, or demographic profile. - Permits price adjustments for spoilage, restocking, or promotions if the new price is applied uniformly to all customers and clearly displayed. - Maintains the consumer's ability to utilize a uniformly available coupon, loyalty discount, or manufacturer rebate that is offered on the same terms to every customer and does not vary based on an external condition. - Makes a violation of these provisions a violation of the Michigan consumer protection act.
