As substituted 2/19/2025: - Prohibits an employer from engaging in electronic monitoring of an employee except to assist job function, monitor production processes or quality, ensure legal compliance, protect health, safety, or security of the employee, or track time worked or production output for compensation. - Requires notice to the employee. - Prohibits employer monitoring in violation of laws, for off-duty employees, to identify employees exercising legal rights, in certain private areas, to determine frequency of visiting private areas, for monitoring an employee's residence or personal vehicle. - Prohibits incorporating facial, gait, or emotion recognition technology. - Prohibits requiring an employee to install an app on a device or wear a device for electronic monitoring unless it is necessary for job functions. - Prohibits using an automated decision system that makes predictions on an employee's behavior unrelated to the job, predicts likelihood an employee will exercise legal rights, make predictions on emotions, uses customer or client data. - Prohibits relying solely on an automated decision system to make employment decisions. Requires an impact assessment. - Prohibits using an automated decision system in regards to an employee's health or in the form of facial, gait, or emotion recognition technology. Protects data used in such systems.
