As amended 9/9/2025: - Prohibits a price offered to a consumer through the consumer’s online device from being generated in whole, or in part, based on any of certain input data, including the presence or absence of any software on the online device. - Permits geolocation data of the online device to be used, and the consumer’s location may be accounted for, to generate a price to, among other things, determine a surcharge based on the real-time demand for the product or service in the consumer’s vicinity, when the product or service is provided immediately upon request. - Excludes any coupon, discount, or other rebate, sale, or promotion that is separate from the price that reduces the price of goods ore services that is issued or offered to the general public on the same terms, and does not use input data. - NOTE: 9/5 amendment prohibits the use of geolocation data of a consumer's online device to set a price based on inferences about the consumer made from such geolocation data. - The 9/9 amendment exempts prices offered to consumers for the repair or maintenance of online devices or to calculate the trade-in value.
