As amended on 2/18/2026: - Requires health care providers to disclose to patients when they are interacting with an artificial intelligence system. - Requires providers using AI for consequential health care decisions to provide patients with prior notice, an opt-out for profiling, an explanation of the decision, and an opportunity for data correction and appeal. - Mandates that providers maintain qualified human oversight personnel to review, evaluate, and validate or override AI outputs used in consequential decisions. - Requires providers to conduct regular performance evaluations of their AI systems for bias and risk, and to submit annual compliance reports to the Department of Health. - The 2/18/2026 amendment clarifes definition of "consequential decision", clarifies that performance evaluations of the AI systems shall include assessment of potential biases beyond those in training data, and deletes the requirement for an annual compliance report.
