As introduced: - Prohibits the use of covered algorithms for consequential actions, including in employment, housing, and credit, in a manner that results in a disparate impact based on a protected characteristic. - Requires developers and deployers to conduct pre-deployment evaluations and annual post-deployment impact assessments, often by an independent auditor, and submit reports to the Division of Consumer Protection. - Prohibits a developer or deployer from engaging in false, deceptive, or misleading advertising of a covered algorithm. - Requires developers to make available information to deployers to comply with these provisions. - Directs the Division of Consumer Protection to create rules establishing an individual's right to opt out of certain algorithmic decisions in favor of a human alternative and to appeal a consequential decision to a human. - Requires a developer or deployer to clearly and conspicuously disclose practices required by these provisions. - Creates a private right of action for individuals to sue for violations and invalidates pre-dispute arbitration agreements for claims under the act.
