As introduced: - Prohibits operators from making a companion chatbot available to a minor if the chatbot is capable of encouraging self-harm, offering unsupervised mental health therapy, or engaging in sexually explicit interactions. - Requires deployers of covered AI products to disclose that a user is not interacting with a human through a persistent disclaimer and periodic pop-up notifications. - Requires generative AI chatbots to contain a protocol to detect user expressions of suicidal ideation or self-harm and redirect the user to crisis services. - Prohibits using a minor’s data to train a generative AI chatbot without obtaining written consent from a parent or legal guardian. - Requires developers and deployers to publish safety test findings, provide a public mechanism for reporting adverse incidents, and report quarterly to the attorney general. - Creates a private right of action for aggrieved users and authorizes the attorney general to bring an enforcement action for violations, including civil penalties up to $25,000 per violation.
