As amended on 3/19/2026: - Prohibits public employers from using an automated decision-making system without meaningful human review for decisions affecting public assistance benefits or employee rights. Requires notice to employees with an appeals process and opportunity for human review. - Prohibits a public employer from using automated decision-making systems to make predictions about an employment candidate's characteristics or behaviors, to subtract from wages, in relation to terms and conditions of employment, or for facial recognition. - Requires public employers to conduct and publish an impact assessment before deploying an automated system and at least every two years thereafter to evaluate for bias and other risks. - Establishes anti-retaliation protections for employees and creates a private right of action for violations of the act. - The 3/19/2026 amendment provides that the definition of "employee" includes employee candidates.
