As introduced: - Establishes a product liability cause of action against developers of high-impact or generative AI systems for harm caused by defective design, inadequate warnings, or breach of an express warranty. - Holds an AI system deployer liable as a developer if the deployer materially modifies the system or intentionally misuses it contrary to an express warranty. - Creates a rebuttable presumption that an AI system is not defective if the developer or deployer adheres to specified risk management practices, including alignment with the NIST AI Risk Management Framework. - Applies a comparative negligence standard to liability actions brought under the act, allowing for joint and several liability.
