As introduced: - Prohibits using an AI, chatbot, or avatar in a commercial transaction without clearly and conspicuously disclosing to the consumer that they are not interacting with a human. - Establishes a private right of action for consumers subjected to a prohibited transaction, allowing for actual damages and statutory damages up to $1,000. - Authorizes class action lawsuits with liability up to $10 million and deems a violation an unlawful practice subject to civil penalties up to $5 million.
