As substituted on 4/30/2026: - Clarifies AI systems to be non-sentient and cannot be granted personhood. Prohibits AI from marrying, serving in corporate roles, or owning property. - Requires clear and conspicuous notice that a person is interacting with an AI system. Requires a licensed professional to exercise independent professional judgment and retain authority over a regulated service, and bears responsibility for any mistakes resulting from the use of AI to render services. Prohibits advertising that an AI system is capable of acting as a licensed professional. Allows the use of AI as a tool in professional practice. - Clarifies end users are not liable just for owning or operating an AI system, but they are responsible for harms caused through its use as if no AI were involved. - Clarifies AI is a product for the purposes of product liability. - Allows courts to pierce the corporate veil when AI systems cause significant harm. - Specifies that AI systems are not persons and do not receive constitutional rights, and their outputs are not automatically protected speech. - Asserts federal preemption over any conflicting laws. - Regulates companion chatbots. Requires a clear and conspicuous notification that a companion chatbot is not human. Requires protocols for preventing the production of suicidal ideation, self-harm, or harm content. Requires a reminder every two hours for the user to take a break. Requires protections for minors, restricting sexually explicit conduct. Requires annual reporting of crisis incidents. Requires a disclosure that companion chatbots may not be suitable for minors.
