As amended on 6/8/2026: - Prohibits an individual or entity from offering therapy or psychotherapy services, including through the use of AI, unless conducted by a licensed professional. - Requires written or verbal informed consent from a patient to use artificial intelligence to record or transcribe psychotherapeutic communications, psychotherapy sessions, or triage or screening. - Prohibits advertising psychotherapy services when the services are provided through the use of companion chatbots. - Prohibits a licensed professional from allowing artificial intelligence to make independent therapeutic decisions, directly interact with clients, generate therapeutic recommendations, assessment results, diagnoses, or treatment plans without review and approval by the licensed professional, or detect emotions or mental states. - Requires the licensed professional to take full responsibility for compliant deployment and clinical appropriateness. - Authorizes the Department of Consumer Affairs to investigate violations and impose civil penalties up to $10,000 per violation. - The 4/7/2026 amendment allows verbal consent. Adds psychotherapy services. Adds to supplementary services allowed. Prohibits conditioning access to care on patient consent. Clarifies the responsibility of a licensed professional.
