Summary

As amended on 4/28/2026: - Requires the operator of a companion chatbot to perform and document a comprehensive risk assessment to identify any child safety risks. - Requires crisis response protocols for self-harm. - Requires safeguards for child users that include usage reminders and disclosures and age-appropriate risk prompts. - Requires default settings that include ephemeral mode for child users, no overnight push notifications, a one-hour limit on a single conversation, and a two-hour time limit for use in a day. - Requires periodic reminders to a child user that the interaction is not with a human. - Requires providing parental controls. - Requires measures that prevent the companion chatbot from engaging in harmful or manipulative behaviors, such as encouraging self-harm, simulating human relationships, providing medical advice without regulation, enabling sexual content, or using engagement tactics that promote dependency or spending. - Prohibits a companion chatbot from targeted advertising at a child, selling or sharing personal information of a child, or using dark patterns. - The introduced version of the bill was a shell bill and the 3/25/2026 amendment added substantive provisions. - The 4/28/2026 amendments clarify "covered harm", delete the definition of "personalize", modify age verification procedures, and amend penalties.
