As passed the Assembly: - Prohibits a retailer from engaging in surveillance pricing, defined as offering a customized price for a good to a consumer based on personal information collected via electronic surveillance technology. - Exempts certain discounts from the prohibition, including those offered through loyalty programs, to broadly defined groups like teachers or seniors, or based on the differential cost of providing the good. - Authorizes public prosecutors to seek civil penalties for violations and allows a consumer to bring an action for injunctive relief. - The 3/23/2026 amendment makes a minor nonsubstantive change. - NOTE: 4/16 amended version establishes a retailer who violates these restrictions will be liable for, upon a civil action brought by the Attorney General, a city attorney, or a county counsel, with each violation with respect to an individual consumer or transaction constituting a separate and distinct violation of a civil penalty not to exceed $12,500 and further listed penalties.
