As introduced: - Prohibits the use of surveillance pricing, defined as increasing the price of a consumer item based on an individual's personal data, to display the total price of an item for sale. - Establishes that dynamic pricing, based on non-individualized data, and retailer loyalty programs are not considered surveillance pricing. - Defines a "retailer loyalty program" as a system of pricing that may decrease the price of a consumer item and may use an individuals personal indentifiable data, and includes, but is not limited to, a promotion, coupon, price reduction, subscription model, or other benefit to retain an existing customer. - Makes a violation of the prohibition on surveillance pricing a violation of the Michigan consumer protection act.
