As substituted on 2/25/2026: - Creates a property right in the voice or visual likeness of an individual in a digital replica. Provides the right is non-transferable during the life of the individual, but extends beyond the death of the individual and is then transferable and licensable, renewable in five-year increments with active use, up to a maximum of 70 years after death. - Applies liability to a platform if it has actual knowledge, willfully avoids knowledge, or receives a compliant notice identifying an unauthorized digital replica or prohibited replica-generating product - The 2/25/2026 substitution adds definitions, extends liability to products or services designed to generate unauthorized digital replicas and expands platform safe harbors and notice-and-takedown mechanics.
