As introduced: - Requires informed consent from a patient for therapy or psychotherapy for a client's therapeutic session to be recorded or transcribed using artificial intelligence. - Prohibits using artificial intelligence to make independent therapeutic decisions; directly interact with clients in any form of therapeutic communication; generate therapeutic recommendations or treatment plans without review and approval by the licensed professional; or detect emotions or mental states. - Requires artificial intelligence or an algorithm used in utilization review to make determinations based on an insured's medical or clinical history and circumstances, and not solely on group datasets. - Prohibits using AI to supplant health care provider decision-making. Prohibits discrimination in violation of law. Requires the AI tool to be open to audit. Prohibits using AI to deny, delay, or modify health care services based on medical necessity.
