As introduced: - Defines "digital sexual image" as a digitally created or altered explicit image or video, including those made with AI, that appears to depict an actual individual. - Creates the Class B misdemeanor offense of digital sexual image abuse for creating or possessing a digital sexual image without the consent of the depicted individual, with penalties increasing to a Level 6 felony for subsequent offenses. - Creates the Class A misdemeanor offense of distribution of a digital sexual image for distributing such an image without consent, increasing the offense to a Level 6 felony for a subsequent conviction. - Exempts law enforcement, courts, news and entertainment media, and newspapers from the law when images or videos are shared for legal, investigative, or journalistic purposes. Exempts cloud service providers and internet or search providers that merely provide access to third-party content and do not create or control material harmful to minors.
