As substituted 3/18/2026: - Prohibits a private review agent or utilization review entity from issuing an adverse determination for healthcare services from being based solely on an artificial intelligence system or from using the system to supersede the judgment of a clinical peer. - Requires adverse determinations made by a private review agent or utilization review entity with an artificial intelligence system to be supplemented with a clinical peer's participation before issuing the determination. - Authorizes the use of artificial intelligence by private review agents to automate tasks and assist in decision-making as part of an approved utilization review plan.
