As substituted 2/26/2026: - Prohibits a supplier from using a consumer's personal data, biometric data, or purchase history to set the price of a good or service. - Permits the use of a consumer's purchase history to operate a customer loyalty program or to offer a discount. - Defines a "customer loyalty program" as a program where a supplier offers a reward or incentive to a consumer for the consumer's repeated purchases, participation, or other similar form of patronage with the supplier. - Requires a supplier that uses an automatic pricing system to retain the data used to set prices for at least three years. - Authorizes the Division of Consumer Protection to enforce these provisions through administrative fines and court action. - NOTE: 2/26 substitute version defines "supplier" and prohibits suppliers from storing the prices a consumer pays in the automatic pricing system.
