As introduced: - Prohibits retail food establishments from engaging in surveillance pricing, defined as adjusting an item's price for a consumer or group based on their personal data. - Defines "surveillance pricing" as adjusting the price of an item for a particular consumer or group of consumers based, in whole or in part, on personal data, including but not limited to, any such adjustments made using electronic surveillance technology or an electronic shelf label. - Allows for discounts based on participation in a loyalty program or membership in a group such as students or military personnel. - Limits price increases on essential commodities to once per day and requires establishments using electronic shelf labels to display a daily maximum price. - Makes a violation of these provisions an unfair or deceptive practice enforceable by the Attorney General and through a private right of action.
