As introduced: - Requires employers to provide written notice to workers and job applicants before using an automated decision system (ADS) for employment-related decisions. - Prohibits an employer from solely relying on an ADS for discipline or termination decisions. - Prohibits the use of an ADS in ways that violate labor, workplace safety, employment, or civil rights laws. Prohibits inferring a worker’s protected status, retaliating against or taking adverse action for exercising legal rights, or making predictions about personal traits, beliefs, health, or behavior that are unrelated to essential job functions. - Grants workers the right to access their data and appeal an employment decision made with the assistance of an ADS to a human reviewer. - Establishes a civil penalty for violations, provides for enforcement by Louisiana Works, and creates a private right of action.
