As amended on 3/23/2026: - Prohibits developers from making or causing artificial intelligence to state or imply that it is a behavioral health care provider or is capable of providing behavioral health care. - Prohibits developers from offering artificial intelligence designed to provide a service that would constitute the practice of behavioral health care. - Requires artificial intelligence to provide a clear notice that the consumer is not communicating with a human and to include protocols to detect suicidal ideation and refer consumers to crisis services. - Authorizes the Attorney General to enforce the law. - The 3/23/2026 amendment adds licensed physicians and nurse practitioners to the definition of "behavioral health care provider" and makes a violation an unfair, abusive, or deceptive trade practice.
