Summary

As enrolled: - 3/26 strikes original text and substitutes the entire bill. - Defines various terms, including but not limited to: "individualized price setting," "individualized wage setting," "price or wage setting algorithm (PWSA)," "surveillance data," "loyalty, membership, or rewards program," and "loyalty program partner." - Prohibits individualized price setting for consumers or individualized wage setting for workers. - Exempts certain common business practices, including dynamic pricing based on supply and demand, loyalty programs, group discounts, and wages based on performance or cost-of-living differences. - Requires a person that uses a PWSA to establish and publish procedures to establish the accuracy of all data considered by the PWSA, allow workers to request, receive, and challenge information on the data the PWSA considers. - Authorizes the Attorney General to adopt rules as necessary to implement and enforce these provisions. - NOTE: 5/5 amended version: - Excludes credit decisions or any action involving an evaluation of creditworthiness, and actions by an insurer or a fraternal benefit society from individualized wage setting. - Excludes discounts offered to address consumer's concern and to maintain the consumer relationship, or to retain consumers from individualized price setting. - Excludes considerations for worker seniority and the tasks a worker was hired to perform data from individualized wage setting.
