As introduced: - Requires online sellers to provide a clear and conspicuous disclosure when a price is personalized for a consumer using surveillance pricing. - Allows a consumer to opt out of surveillance pricing and receive a non-personalized baseline price for goods or services. - Defines "surveillance pricing" as algorithmic pricing that uses a consumer's personal data to generate a personalized price increase. - Defines "covered entity" as any person or entity that sells or offers to sell goods or services through an online platform to consumers in the state. - Prohibits the use of specified personal information, including race, religion, sexual orientation, and medical information, to generate algorithmic pricing. - Exempts insurers and providers of financial services from the requirements of the act. - Makes a violation an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act and preempts home rule authority on the matter. - Establishes an effective date of January 1, 2028.
