As introduced: - Establishes requirements for insurers that use artificial intelligence (AI) in utilization review, including requiring consumer notification, disclosure of algorithm information, and submission of algorithms to the superintendent for review. - Requires insurers to disclose the use of AI algorithms in any notice of an adverse determination issued during utilization review. - Prohibits insurers from using AI systems to make adverse determinations solely based on group datasets. Prohibits AI systems used in utilization review from directly or indirectly causing harm to insureds or enrollees. - Allows the superintendent to inspect AI systems used in utilization review for audits and compliance reviews. - Prohibits an AI algorithm from being the sole basis for an adverse determination and requires that all such determinations be made by a clinical peer reviewer. - Requires insurers to establish ongoing quality assurance testing processes for AI systems used in utilization review, submit testing results to the superintendent at least twice a year, and publish those results publicly within 30 days.
