As amended on 2/3/2026: - Requires the State Administrator of Elections, upon receiving a credible report of election misinformation or disinformation, to disseminate correct information and authorizes the administrator to seek injunctions and issue subpoenas. - Authorizes the State Board of Elections to file a civil action and seek damages against entities that publish election misinformation or disinformation. - Prohibits the knowing or reckless dissemination of a deepfake intended to influence a voter's decision or misrepresent election information. - Establishes that a violation of the deepfake prohibition is a misdemeanor punishable by a fine of up to $5,000, imprisonment for up to 5 years, or both. - The 2/3/2026 amendment clarifies a civil action can only be filed by the state board against a person who created, used, or disseminated election misinformation, not one who published the misinformation. Deletes requirement that a broadcaster make a good faith effort the deepfake is not a deceptive and fraudulent deepfake to be exempt.
