As introduced: - Prohibits collecting, recording, or sharing an individual's neural data without informed consent. - Prohibits using a brain-computer interface to bypass the conscious decision of an individual without informed consent. - Requires a health care provider that uses generative AI to generate patient communications to include a disclaimer. - Requires a mental health chatbot to disclose to a consumer it is not human. Prohibits a mental health chatbot from selling or sharing identifiable health information or user input without consent. Prohibits a mental health chatbot from advertising products without a clear and conspicuous identification that it is an advertisement. - Prohibits health plans from using artificial intelligence to deny, delay, or modify health care services based on medical necessity, requiring such determinations be made by a licensed human provider.
