As amended on 4/28/2026: - Allows a licensed therapist to use artificial intelligence for supplementary support to record of transcribe a session only if the patient is informed and gives written consent. - Prohibits advertising or providing therapy or psychotherapy services through the use of internet-based artificial intelligence unless services are conducted by a licensed professional. - Prohibits a licensed professional from allowing artificial intelligence to make independent therapeutic decisions, directly interacting with clients in therapeutic communications, generating therapeutic recommendations or treatment plans without review and approval from a licensed professional, or detecting emotions or mental states. - Exempts religious counseling, peer support, or self-help resources. Provides for civil penalties.
